1. Introduction

Welcome to YOKATV Online+ (the “App”). These Terms and Conditions (“Terms”) constitute a legal agreement between you and YOKATV governing your access to and use of the App and related services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

These Terms apply to the YOKATV Online+ application and related App services.

2. Changes to These Terms

YOKATV may change, modify, update, add, or remove portions of these Terms from time to time. When material changes are made, YOKATV may update the “Effective Date” and “Last Updated” shown at the beginning of these Terms and, where appropriate, provide notice through the App or other reasonable means.

Your continued use of the App after updated Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.

3. Privacy

Your use of the App is also subject to the YOKATV Privacy Policy.

The Privacy Policy explains what information may be collected, how it is used, how it is protected, and how you may request access to or deletion of your information.

4. App Purpose and Content

YOKATV Online+ is a media player application that allows users to access and play media resources that they independently provide, configure, or are otherwise legally authorized to access. The App does not itself provide, sell, license, host, distribute, or guarantee access to television channels, movies, series, playlists, or other third-party media content.

YOKATV does not authorize or encourage copyright infringement, unauthorized redistribution, or unauthorized access to third-party content or services.

You are solely responsible for ensuring that any media source, IPTV account, playlist, URL, stream, or other content that you add to or access through the App is lawful and that you have the necessary rights, permissions, or licenses to use it. YOKATV may restrict, suspend, or terminate access where there is a reasonable basis to believe that the App is being used for unlawful activity or to infringe third-party rights.

5. Third-Party Services and Media Sources

The App may connect to IPTV servers, media servers, authentication services, or other third-party services configured or selected by you. YOKATV does not control third-party servers, streams, playlists, channels, media libraries, service availability, quality, legality, or content.

Your relationship with any third-party IPTV or media service provider is separate from your relationship with YOKATV and may be subject to that provider’s own terms and privacy policies.

YOKATV is not responsible for the legality, accuracy, availability, or quality of third-party content or services accessed through the App.

6. User Account

To access certain functionality, you may be required to create or use an account.

You agree to provide accurate information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for activities performed through your account. You must not use another person’s account without authorization, circumvent authentication mechanisms, or attempt to gain unauthorized access to any account or service.

7. Prohibited Conduct

You must not use the App:

1.      For unlawful, fraudulent, or harmful activities;

2.      To infringe or facilitate the infringement of copyright, trademark, or other intellectual property rights;

3.      To access media or services without authorization;

4.      To distribute, reproduce, sell, or commercially exploit third-party content without the necessary rights;

5.      To introduce malware, malicious code, or other harmful software;

6.      To interfere with the App, our systems, or other users;

7.      To reverse engineer, circumvent security controls, or attempt unauthorized access to the App or related systems, except where such restrictions are prohibited by applicable law.

YOKATV may suspend or terminate access where we reasonably believe that a user has violated these Terms, applicable law, or the rights of others.

8. Intellectual Property

Unless otherwise stated, YOKATV and/or its licensors own the intellectual property rights in the App, its interface, software, trademarks, logos, documentation, and related materials.

Nothing in these Terms grants you ownership of YOKATV intellectual property. You may use the App only in accordance with these Terms and applicable law.

9. User-Provided Content and Media Sources

You retain responsibility for content, URLs, playlists, credentials, and other materials that you independently provide, configure, or access through the App. By using the App to access third-party content, you represent that you have the legal right or authorization to do so.

YOKATV does not claim ownership of third-party media content accessed through the App solely as a result of your configuration or use of a third-party service.

10. Paid Features and Payments

The iOS version of the App is currently provided without in-app purchases for digital content or functionality, unless a specific purchase option is expressly presented to you within the App.

YOKATV does not use the App to instruct users to bypass Apple’s in-app purchase rules or payment requirements. If paid digital features or subscriptions are introduced in the future, applicable pricing, billing period, renewal, cancellation, and other purchase terms will be presented before purchase and will be subject to the applicable App Store rules and requirements. Any separate purchase of third-party IPTV or media services is between you and the relevant third-party provider and is not a purchase of media content from YOKATV through this App.

11. Account Suspension and Termination

YOKATV may suspend or terminate your access to the App if you:

·         Materially breach these Terms;

·         Use the App for unlawful purposes;

·         Infringe third-party intellectual property rights;

·         Attempt unauthorized access or abuse of the App or related systems;

·         Engage in conduct that may harm YOKATV, other users, or third-party service providers.

Upon termination, your right to use the App and affected services will cease. Account deletion and data retention are governed by the Privacy Policy and applicable law.

12. No Warranties

The App and related services are provided on an “as is” and “as available” basis to the extent permitted by applicable law.

YOKATV does not guarantee that:

·         The App will always be available or uninterrupted;

·         The App will be compatible with every device or operating system;

·         Third-party services or media sources will remain available;

·         Third-party content will be accurate, lawful, or uninterrupted;

·         All errors or defects will be corrected.

13. Limitation of Liability

To the maximum extent permitted by applicable law, YOKATV shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App or third-party services.

This includes, to the extent permitted by law, losses arising from third-party IPTV services, media sources, streaming interruptions, account configuration, unauthorized third-party access, or content accessed through sources provided by you. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

14. Third-Party Websites and Services

The App or related YOKATV services may contain links to or integrations with third-party websites, applications, or services. YOKATV does not control those third-party services and is not responsible for their content, privacy practices, availability, or terms.

Your use of third-party services is governed by the applicable third-party terms and policies.

15. Intellectual Property Complaints

If you believe that content or use of the App infringes your intellectual property rights, you may contact YOKATV at support@yokatv.com with sufficient information to identify the relevant material, the rights allegedly infringed, and your contact information. YOKATV may investigate legitimate complaints and may take appropriate action where required by applicable law.

16. Electronic Communications

By using the App or providing contact information, you may receive service-related communications necessary to operate your account or provide the services. Where required or permitted by law, you may opt out of promotional communications. Opting out of promotional communications will not prevent YOKATV from sending important service, security, account, or legal notices.

17. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless YOKATV and its affiliates, officers, employees, agents, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

·         Your violation of these Terms;

·         Your unlawful use of the App;

·         Your infringement of third-party rights;

·         Your unauthorized use of third-party content or services.

18. Age Requirement

The App is intended for users who are at least 18 years old, unless a different minimum age is required by applicable law. By using the App, you represent that you meet the applicable age requirement and have the legal capacity to agree to these Terms.

19. Governing Law and Dispute Resolution

These Terms shall be governed by the laws applicable to the agreement between you and YOKATV, subject to any mandatory consumer protection laws that apply to you. Before initiating formal proceedings, the parties should first attempt in good faith to resolve a dispute by contacting support@yokatv.com.

Any arbitration or dispute-resolution provision shall apply only to the extent permitted by applicable law and shall not deprive consumers of mandatory rights available under the laws of their jurisdiction.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

21. No Waiver

A failure by YOKATV to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
